Duty of Candour

Under Part 2 of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016, organisations which provide health, care or social work services must follow the “duty of candour procedure” when there has been an unintended or unexpected incident that results in death or harm to an individual.

The Comhairle has a Duty of Candour Policy Statement & Procedural Guidance (2021) which provides details of the procedure which is to be followed.

The Comhairle is required to produce an annual report setting out the number of incidents to which the duty of candour procedure has been applied, and other relevant matters.
